September 29, 2020 COGCC PRELIMINARILY APPROVES 200–600 SERIES MISSION CHANGE RULES

On September 28, 2020, the Colorado Oil and Gas Conservation Commission completed its deliberations on the 200 through 600 Series Mission Change Rules and unanimously voted to preliminarily approve the Rules subject to conforming changes in the upcoming 800, 900 and 1200-Series Rulemaking Hearings and approval of a finalized Statement of Basis and Purpose. The record is now closed for the 200 through 600 Series Rules as the Commission turns to the 800, 900 and 1200-Series Rulemaking Hearings from October 6th through November 6th. The Commission intends to meet again on the 200 through 600 Series Rules on November 4th to check in with COGCC Staff on proposed conforming edits and an updated draft Statement of Basis and Purpose. Once the Commission formally adopts the finalized 200 through 600 Series Rules in November, which will be final agency action, the Rules are scheduled to become effective on January 1, 2021. The adopted 200 through 600 Series Rules implement Senate Bill 19-181 and will result in sweeping changes to the COGCC’s definitions, general and operational Rules, permitting Rules, and procedural and safety Rules, including a 2,000’ residential setback for any new or pending Oil and Gas Location.
