May 13, 2020 COGCC AND CPW RELEASE FAQ DOCUMENT, HIGH PRIORITY HABITAT TABLE AND EXTEND INITIAL COMMENT DEADLINE FOR 800, 900 AND 1200-SERIES MISSION CHANGE RULES
On May 13, 2020, the COGCC and Colorado Parks and Wildlife (“CPW”) released an FAQ Document for the May 1, 2020 draft of the 1200-Series Wildlife Rules as part of the COGCC Mission Change Rulemaking. The FAQ Document provides guidance on what a High Priority Habitat is, how the COGCC and CPW will implement Alternative Location Analysis, what a Wildlife Protection Plan and Wildlife Mitigation Plan are, how the proposed mitigation fee will be calculated, and what “indirect impacts” are, among other topics. On May 14, 2020, the COGCC and CPW released a High Priority Habitat Table which contains identified species and habitats as well as recommendations to avoid and minimize impacts to wildlife. Following the release of these documents, the COGCC extended the initial stakeholder comment deadline on the 800, 900 and 1200-Series Rules to Wednesday May 20 at 5:00 p.m. The CPW FAQ Document and High Priority Habitat Table can be found here:
