September 4, 2019 COGCC ESTABLISHES PERMITTING PROTOCOL FOR WELD COUNTY DESIGNATED 1041 AREA OF SPECIAL INTEREST

On September 3, 2019, the COGCC executed a Memorandum of Understanding with Weld County regarding Weld County’s 1041 WOGLA permit process. Under the terms of the MOU the COGCC must provide comments to Weld County within 28-days of receipt of a WOGLA, and the COGCC must grant, deny, or otherwise respond to a Form 2 and 2A within 60-days of completeness (or, in the case of a 2A, the later of 2A completeness or entry of a DSU order). The Form 2 cannot be approved by the COGCC until WOGLA disposition by Weld County.

On September 4, 2019, the COGCC announced its permitting protocol for the Weld County 1041 Area of State Interest. The COGCC takes the position that the MOU does not supplant COGCC using a priority list to determine what permits are being reviewed, and the COGCC will continue to receive operator priority lists in concert with the MOU’s provisions. For Weld County permit applications, the COGCC stressed that it will continue to be important for operators to submit permits to COGCC that are consistent with the operator’s priority list.
