July 22, 2019 COGCC ISSUES NOTICE TO OPERATORS REGARDING WELD COUNTY 1041 AUTHORITY

On July 22, 2019, the COGCC issued a Notice to Operators regarding Weld County’s 1041 regulations over oil and gas development through the WOGLA process. Despite Weld County’s 1041 authority designation, the COGCC will continue to require approved Form 2A and Form 2 permits in unincorporated Weld County, and the COGCC will continue to require compliance with its own regulations even if its regulations are inconsistent with Weld County’s regulations.

As background, “1041” authority is derived from 1974 legislation (proposed under HB 74-1041) to allow local governments to identify, designate and regulate areas and activities of state interest through a local permitting process. On July 8, 2019, the Weld County Commissioners unanimously approved the creation of an Oil and Gas Department within the County. The Board of Weld County Commissioners will implement code changes related to the new 1041 WOGLA process effective on August 5, 2019. In order for Weld County’s 1041 regulations to be effective, the COGCC must enter into an Intergovernmental Agreement (IGA) with the County.
