August 11, 2023 ECMC Announces Cumulative Impacts Informational Hearing Docket

On August 11, 2023, the Energy and Carbon Management Commission (ECMC) formally announced an informational hearing docket to seek stakeholder input as to how the Commission should proceed in scoping and developing draft rules that evaluate and address cumulative impacts. The ECMC informational docket follows House Bill 23-1294, which was signed into law on June 6, 2023, and requires the ECMC to adopt rules that evaluate and address the cumulative impacts of oil and gas operations and to adopt a definition of “cumulative impacts,” no later than April 28, 2024. The ECMC specifically asks stakeholders and interested persons to answer the following two questions: 1) to what extent and how could the ECMC’s rules for permitting oil and gas locations be amended to consider the cumulative impacts identified in § 34-60-106 (11)(d)(I); and 2) how should the ECMC’s current cumulative impacts process, such as its use of data collected in the “Cumulative Impacts Data Evaluation Repository” database, evolve to take into consideration the cumulative impacts identified in § 34-60-106 (11)(d)(I). Written comments must be submitted by September 15, 2023, and the Commission will take public comment from interested persons at a hearing on October 12 and 13, 2023.
