July 5, 2022 OPERATOR ANNUAL MITIGATION FEE DUE AUGUST 1, 2022
As a reminder, pursuant to COGCC Rule 205.c, an Operator that has filed a Form 1 and is operating one or more Wells in Colorado must file a Form 1B, “Mitigation Fee” (formerly “Annual Registration”) by no later than August 1, 2022. Beginning in 2023, an Operator will file a Form 1B no later than April 30 of each year. The annual mitigation fee is $225 per Well for Operators with an average daily per-Well production greater than 15 BOE or 22 MCFE for the previous calendar year; or $125 per Well for Operators with an average daily per-Well production less than or equal to 15 BOE or 22 MCFE for the previous calendar year. The Form 1B has not yet been released by the COGCC but will be shortly. Pursuant to the recently adopted Orphan Well Mitigation Fee Rulemaking approved by the Commission on June 30, 2022, effective August 1, 2022, Rule 205.c will be amended to reference the Mitigation Fee and not a Registration Fee.
