August 11, 2020 WOGCC POLICY UPDATE – PROTEST POLICY FOR ACCEPTING APDs BEFORE SPACING HEARINGpdf
At the August 11, 2020 Meeting of the Wyoming Oil and Gas Conservation Commission (“Commission”), Commission Supervisor Mark Watson announced that given the current status of the industry and the implementation of the new APD Rule, he has updated several policies to address those impacts on the Commission hearings. The Policy for Accepting APDs before Spacing Hearing was updated on August 3, 2020. This is the 2nd iteration of this policy. The initial policy allowed operators to file APDs three (3) months prior to the corresponding spacing hearing. This had largely paralleled the Commission’s hearing docket schedule. However, the application filing timeline has recently been adjusted and the three (3) month grace period no longer aligns with the hearing schedule. Therefore, instead of providing another timeline, the policy provides that an operator may file APDs concurrently (on the same day) as a spacing application and not any sooner. If a docket number has not been assigned to the spacing application at the time the APD is filed, operators should put a check number for the check submitted with the spacing application.
