July 6, 2020 COGCC CONTINUES 800, 900, AND 1200-SERIES RULEMAKING HEARING
On July 6, 2020, the COGCC ruled on a Motion filed by the Western and Rural Local Government Coalition and Garfield County in the 800, 900 and 1200-Series Mission Change Rulemaking and granted the request to defer the Rulemaking hearing on these three Rule Series. The 800, 900 and 1200-Series Rulemaking hearing will now take place from September 28 to October 9, 2020. The 200 through 600-Series Mission Change Rulemaking will remain as scheduled from August 24 through September 10, 2020. Pursuant to the Hearing Officer’s Order, at the conclusion of the 200-600 Series Rulemaking, the Hearing Officer recommends that the Commission close the record to all party input and after the record is closed to party input, but prior to the Commission taking a final vote to adopt the 200-600 Series Rules, the Commission may make any necessary or conforming changes to the 200-600 Series Rules to accommodate any decisions that may be made in the 800/900/1200 Series Rulemaking. Several Citizen Groups submitted a Response to the Motion to Defer requesting that the Director not approve any Form 2, Application for Permit-to-Drill, or Form 2A, Oil and Gas Location Assessment that triggers one of the Director’s Objective Criteria until the entirety of the Mission Change Rules are adopted and effective. The Hearing Officer declined to rule on the Citizen Groups’ request and held that such a request is not properly before the Hearing Officer as it is not a matter noticed for consideration in the 800/900/1200 Series Rulemaking.
