February 5, 2024 ECMC Releases Carbon Capture and Sequestration Study

On February 1, 2024, the ECMC released the study, “Carbon Capture & Storage: Safety and Impact Considerations from Source to Sequestration” as required by SB 23-016. The required safety study on carbon capture and sequestration (CCS) includes Class VI well safety, the evaluation of air quality impacts of capture technologies, pipeline safety, subsurface containment, and recommendations for safety measures. Moving forward, the ECMC anticipates a Rulemaking to address Class VI wells, the implementation of a legal framework for ownership and utilization of pore space and aggregating property rights, the potential for state-based inspection and regulation of CO2 pipelines, and continued communication and education for the public on CCS projects.
